These Terms of Service govern your use of musicclippingagency.com and any services provided by Music Clipping Agency (a Lumina Clippers company, “we”, “us”). By using our site or engaging our services, you agree to these terms.

Eligibility

Our services are for artists, labels, managers and businesses, and are intended for adults aged 18 or over. By using the site you confirm you meet these requirements and have authority to act for the artist or company you represent.

Our services

We provide short-form clipping and distribution services for music. Specific scope, deliverables, fees and timelines for any engagement are set out in a separate proposal or agreement, which takes precedence over these terms where they conflict.

Acceptable use

• Do not use the site or services for any unlawful purpose, or in breach of the platform rules that apply to you.
• Do not attempt to disrupt, reverse-engineer, or gain unauthorised access to the site.
• You are responsible for the accuracy and legality of the recordings, artwork, assets and claims you provide to us.

Rights and clearances

You confirm that you own or control the rights needed for us to clip and distribute the recordings and assets you send us, including the relevant master and publishing permissions. You remain responsible for third-party clearances, such as samples, interpolations and featured artists.

Intellectual property

You retain ownership of your recordings and source material. The site, its content and our brand belong to us or our licensors. Ownership of campaign deliverables is set out in your engagement agreement. You grant us the rights needed to run and report on your campaign.

Fees and results

Fees, billing and any performance terms are defined in your agreement. View counts, streams and other outcomes depend on many factors outside our control, including the record itself and platform algorithms. Figures shown on this website describe past or aggregate performance and are not a guarantee of future results. We do not guarantee specific views, streams, chart positions or revenue.

Disclaimers

The site and services are provided “as is” without warranties of any kind, to the fullest extent permitted by law. Nothing on this site is legal, financial or professional advice.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential losses, and our total liability arising from the services is limited to the amount you paid us for the engagement giving rise to the claim.

Indemnity

You agree to indemnify us against claims arising from your breach of these terms, from the assets or content you provide, or from your failure to hold the rights or approvals required for a campaign.

Governing law

These terms are governed by the laws of the State of New Mexico, USA, and any disputes are subject to the courts located there, unless your agreement states otherwise.

Changes

We may update these terms from time to time. Continued use of the site after changes are posted means you accept the updated terms.
